This Privacy Policy (“Policy”) describes how AmpUp collects, accesses, uses, discloses, and otherwise processes your information.
AmpUp, Inc. (“AmpUp,” “we,” “us,” or “our”), provides software solutions and services for electric vehicle (EV) drivers, charging infrastructure hosts and other stakeholders to support EV adoption and reduce range anxiety.
This Privacy Policy (“Policy”) describes how AmpUp collects, accesses, uses, discloses, and otherwise processes your information. This Privacy Policy applies to data processing related to all of our products, services, and websites, including our AmpUp mobile and web applications and cloud based software solutions, your AmpUp account (if you have registered or are registering your account), and AmpUp identifiable QR codes. To make this Privacy Policy easier to read, our products, services, websites, mobile and web applications, and our other online or offline offerings are collectively called the “Services.”
An Important Note: This Privacy Policy does not apply to any of the personal information that we process on behalf of our customers through their use of our Services (“Customer Data”). Our customers’ respective privacy policies govern their collection and use of Customer Data. Our processing of Customer Data is governed by the contracts that we have in place with our customers, not this Privacy Policy. Any questions or requests relating to Customer Data should be directed to our customer.
By using our Services you acknowledge that you are familiar with this Privacy Policy and that you permit us to process your personal information in accordance with this Privacy Policy.

AmpUp may collect information about you or others through our affiliates or non-affiliated third parties, services, and organization. For example, Site Hosts may provide us with additional details about users who will be charging at the stations hosted by the Site Host, including contact information of others; or if you access our Services through a third-party application, such as an app store or a third-party login service, we may receive your personal information from them.
We may also collect information about you from non-affiliated third parties for fraud or safety protection purposes. We likewise may combine information that we collect from you through the Service with information that we obtain from such third parties and information derived from any other products or services we provide.
3. Information We Collect Automatically
We may collect personal information automatically when you use our Services.
(a) Location Information. We may collect precise location information, such as where you complete a charging session, or otherwise in connection with your use of our Services.
(b) Cookies. Cookies are small text files placed in device browsers that store preferences and facilitate and enhance your experience.
(c) Pixel Tags/Web Beacons. A pixel tag (also known as a web beacon) is a piece of code embedded in our Services that collects information about engagement on our Services. The use of a pixel tag allows us to record, for example, that a user has visited a particular web page or clicked on a particular advertisement. We may also include web beacons in e-mails to understand whether messages have been opened, acted on, or forwarded.

When you provide permission for data processing through our mobile application, we process information about your location for the purpose of locating the charging station closest to you and enabling you to begin charging once you are within a specified proximity to the charger.
We may use personal information to tailor and provide you with content and advertisements. We may provide you with these materials as permitted by applicable law. Some of the ways we may market to you include email campaigns, [text messages,] custom audiences advertising, and “interest-based” or “personalized advertising,” including through cross-device tracking. We may use personal information to create de-identified and/or aggregated information, such as demographic information, information about the device from which you access our Services, or other analyses we create.
AmpUp is committed to data privacy and safety and will share the information we collect from you in the following cases, all in accordance with the applicable law:
(a) With our Service Providers and vendors that assist us with the provision of our Services, which may include IT support, hosting, payment processing, customer service, and other related services;
(b) With our Affiliates;
(c) With Business Partners, such as Site Hosts when you connect with a AmpUp operated by a Site Host;
(ad) With our Advertising Partners who may set tracking technologies on our Services to collect information regarding your activities and your device (e.g., your IP address, cookie identifiers, page(s) visited, location, time of day). These advertising partners may use this information (and similar information collected from other services) for purposes of delivering personalized advertisements to you when you visit digital properties within their networks. This practice is commonly referred to as “interest-based advertising” or “personalized advertising”;
(e) With other users or third parties you share or interact with;
(f) In connection with the negotiation, diligence, or actual merger, acquisition, financing, reorganization, bankruptcy, receivership, purchase or sale of assets, or transition of service to another provider related to some or all of AmpUp assets or business, your information may be sold or transferred as part of such a transaction as permitted by law or contract; or
(g) We may access, preserve, and disclose any information we store associated with you to external parties if we, in good faith, believe doing so is required or appropriate to: comply with law enforcement or national security requests and legal process, such as a court order or subpoena; protect your, our, or others’ rights, property, or safety; enforce our policies or contracts; collect amounts owed to us; or assist with an investigation or prosecution of suspected or actual illegal activity.
Links to third party websites or applications may be made available through our Services. Clicking on such links will direct you to the website or application of a third party that we do not control. Any personal data you provide via those sites is subject to the Privacy Policies on those websites and is not covered by this Policy. We do not endorse, screen, or approve, and are not responsible for, the privacy practices or content of such other websites or applications. Providing personal information to third-party websites or applications is at your own risk. You are encouraged to read the privacy statements of every website you visit or application you use.
We reserve the right to contact you for non-promotional purposes, such as to provide receipts or send you messages related to your account with us.

The online advertising industry also provides websites from which you may opt out of receiving targeted ads from data partners and other advertising partners that participate in self-regulatory programs. Our Services are available to persons over: (i) the age of 18, or (ii) the legal age of majority in the territory where he/she uses the Services or (iii) the minimum driving age in the territory where he/she uses the Services (the minimum age limit). If you are under the minimum age limit, and particularly if you are under the age of 13 our Services may be available to you only with the consent and approval of a holder of parental responsibility over you in accordance with the applicable law. AmpUp makes reasonable efforts to verify if the consent is given or authorized by the holder of parental responsibility over the person under the minimum age limit. In the event that we learn that you are under the minimum age limit, and particularly under the age of 13, and that you are visiting our online services without verification of parental consent, we will delete information collected from you. In the event AmpUp learns that you are under the minimum age limit, and particularly under the age of 13, and we have inadvertently collected “personal information” (as defined by the United States Children’s Online Privacy Protection Act), and that you are visiting our online services without verification of parental consent, we will take reasonable steps to delete information collected from you as soon as possible as required by applicable law. AmpUp requests if you are less than the minimum age limit to not submit information to us.
AmpUp may revise this Policy from time to time at our sole discretion. We will post changes in this notice, or as otherwise required by law. We suggest that you periodically revisit this notice to stay informed of any changes. If we make a material change to the Policy, you will be provided with appropriate notice in accordance with legal requirements, which may be through email or mobile application notification. By continuing to use the Service, you are confirming that you have read and understood the latest version of this Policy.
This Supplemental Notice for California Residents only applies to our processing of personal information that is subject to the California Consumer Privacy Act of 2018 (“CCPA”). “Sales” of Personal Information under the CCPA
For purposes of the CCPA, AmpUp does not “sell” personal information, nor do we have actual knowledge of any “sale” of personal information of minors under 16 years of age.
Additional Privacy Rights for California Residents
Non-Discrimination. California residents have the right not to receive discriminatory treatment by us for the exercise of their rights conferred by the CCPA.
Authorized Agent. Only you, or someone legally authorized to act on your behalf, may make a verifiable consumer request related to your personal information. You may also make a verifiable consumer request on behalf of your minor child. To authorize an agent, provide us with written authorization signed by you and your designated agent by contacting us as set forth below for additional instructions.
Verification. To protect your privacy, we will take steps to reasonably verify your identity before fulfilling your request. These steps may involve asking you to provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information (or to verify an authorized representative to speak on your behalf), or to answer questions regarding your account and use of our Services.

De-Identified Information. If we create or receive de-identified information, we will not attempt to re-identify such information, except to comply with applicable law.
We are committed to protecting the security of your information. AmpUp has implemented administrative, physical, and technical security measures that are designed to protect your information under our control. We use a variety of industry-standard security technologies and procedures to help protect your information from unauthorized access, use or disclosure. Unfortunately, no system is 100% secure, and we cannot ensure or warrant the security of any information you provide to us. To the fullest extent permitted by applicable law, we do not accept liability for unauthorized access, use, disclosure, or loss of personal information.
You should take steps to keep your information safe (including your password) and to log out of your account after use. Where we have provided you, or you have chosen, a password which enables you to access certain parts of any of our Services, you are responsible for keeping your password confidential. You must not share these passwords with anyone or store them in a way that may allow a third party to access them. If that happens, you agree to report it immediately to help@ampup.io. AmpUp cannot be held responsible for your failure to keep your password secure. You must update your password periodically using best practices (such as strengthening your password with the combination of uppercase and lowercase letters, numbers, punctuation, and other symbols) to help reduce the risk of unauthorized access to your account with us.
By using our Services or providing personal information to us, you agree that we may communicate with you electronically regarding security, privacy, and administrative issues relating to your use of our Services. If we learn of a security system’s breach, we may attempt to notify you electronically by posting a notice on our Services, by mail, or by sending an email to you.
All information processed by us may be transferred, processed, and stored anywhere in the world, including, but not limited to, the United States or other countries, which may have data protection laws that are different from the laws where you live. We endeavor to safeguard your information consistent with the requirements of applicable laws.
If we transfer personal information which originates in the European Economic Area, Switzerland, and/or the United Kingdom to a country that has not been found to provide an adequate level of protection under applicable data protection laws, one of the safeguards we may use to support such transfer is the EU Standard Contractual Clauses.

We store the personal information we collect as described in this Privacy Policy for as long as you use our Services, or as necessary to fulfill the purpose(s) for which it was collected, provide our Services, resolve disputes, establish legal defenses, conduct audits, pursue legitimate business purposes, enforce our agreements, and comply with applicable laws.
Supplemental Notice for Nevada Residents. If you are a resident of Nevada, you have the right to opt-out of the sale of certain personal information to third parties who intend to license or sell that personal information. Please note that we do not currently sell your personal information as sales are defined in Nevada Revised Statutes Chapter 603A. Supervisory Authority. If your personal information is subject to the applicable data protection laws of the European Economic Area, Switzerland, or the United Kingdom, you have the right to lodge a complaint with the competent supervisory authority or attorney general if you believe our processing of your personal information violates applicable law.
